Through this privacy statement, CasinoNieuws.nl and Onetime inform you of the manner in which personal data received by the Online Casino van het Jaar election is handled as part of the organization of the Online Casino of the Year election and the associated election process. Organized by CasinoNieuws.nl and OneTime, Online Casino of the Year seeks the best online casino in the Netherlands, which is determined by the public and the expert jury. Safeguarding your privacy is an important task for us. Online Casino of the Year respects your privacy and protects your data.
Because we believe it is important to be transparent, we have chosen to provide a comprehensive privacy statement. We process your personal data if you have received an invitation to attend the Election and/or if you are eligible to vote in the Online Casino of the Year Election (“Election”). In this privacy notice, we explain what data we collect from you and why, whether we share that data with others, how long we keep it for and what your rights are.
All articles in this privacy statement are in accordance with the applicable General Data Protection Regulation (GDPR/AVG). This European privacy law has been applicable in the Netherlands and the European Union since May 25, 2018.
Personal data is any information that identifies or can be linked to a natural person. When you are eligible for (one of) our services we need some data from you in order to provide that service. For example, we need data so that you can cast a vote or so that you can be present at the Election. Your personal data will only be processed by Online Casino of the Year if you yourself share data with us.
Online Casino of the Year may process one or more of the personal data listed below about you:
Anyone in the Netherlands aged 24 and older can cast his or her vote during the Election. The Election is not suitable for minors and persons under the age of 24. We do not actively collect information about anyone under the age of 24. If you suspect that someone is under the age of 24 and that we have collected information from them, please contact us.
When you use the website or services of Online Casino of the Year, your personal data is processed. This is done in different ways, for different purposes. Under the AVG, we are required to have a lawful basis for processing your personal data. The following bases apply to our situation: performance of an agreement, consent, compliance with legal obligations and legitimate interests. Specifically, Article 6 paragraph 1 sub a, sub b, sub c and sub f of the AVG apply.
We always process your personal data under one of the following bases:
The AVG, Article 13(1)(c) requires Online Casino of the Year to record the ‘processing purposes’ for which personal data is used. This means that we must describe why Online Casino of the Year requests or receives the data and what Online Casino of the Year does with the data.
If you have received an invitation from Online Casino of the Year to attend the Election (or if you are registered as a guest), we collect personal data such as first and last name, contact details and type of invitee (nominee, guest, juror, etc.).
The bases for processing in this context: performance of the agreement (to be able to organize the Election. Think of sending the invitation, confirmation and possibly other information about the Election), our legitimate interest (to be able to organize the Election and to send an evaluation after the Election).
If you have contacted Online Casino of the Year in any way, such as by filling out the contact form, the data you provide will be retained and used for the purpose of further contact. This includes name, email address and phone number.
The bases for processing in this context: our legitimate interest (in order to respond to your questions and contact requests, we process your data so that we can provide you with the best possible service).
To keep you informed around developments regarding the Election, we are sending out a newsletter. You can subscribe to this newsletter. If you subscribe to the newsletter we will process at least your e-mail address. We may process data such as your first and last name.
The bases for processing in this context: your consent (making it known to Online Casino of the Year that you are interested in receiving our newsletter), our legitimate interest (for communication and information about the Online Casino of the Year election).
If you participate in the voting as a juror, your photo, name, and organization will be used for the announcement on the website. There is also a brief biography that may include personal information.
The bases for processing in this context: performance of the contract (so we can organize the election process), our legitimate interest (to communicate about the ballots).
When you cast a vote, you automatically participate in the win action that Online Casino of the Year, in addition to the Election, organizes. The prizes are raffled off among the voters, therefore we only collect your email address.
The bases for processing in this context: legitimate interest (without the data, the prizes cannot be raffled).
We collect information about your visit to our website and how you use it. This may include your IP address, geographic location, device information, browser type, referral source, length of visit, operating system, number of pages viewed, which pages you viewed and similar information. This information may be collected on our behalf by a third-party website analytics service provider and/or may be collected using cookies.
Online Casino of the Year maintains usage data of the website(s) for statistical purposes. Personal data collected in this way is in principle anonymous. The Online Casino of the Year website uses cookies from Google Analytics to track, in outline, user behavior and general trends and to obtain reports. This helps to improve the operation of the website. Google may provide this information to third parties if Google is legally required to do so or insofar as third parties process the information on Google’s behalf. By using the Online Casino of the Year website, you consent to the processing of the information by Google in the manner and for the purposes described above. Cookies are also set through the use of buttons and/or links, as described above under ‘Use of social media’. Online Casino of the Year has no control over the placement and use of cookies by those third parties.

We do not keep your personal data longer than necessary. How long depends on the purpose for which your data is processed. In most cases, there is no fixed retention period; we determine this on a per-processing basis. An exception is if the law requires us to keep certain data even longer.
Above we have indicated the processing purposes for which we use your personal data. Although no concrete or legal retention periods can be found in the AVG, we are obliged to indicate how long we keep your personal data. This is set out in Article 13(2)(a) of the AVG.
In order to offer you the best possible services, we share certain data with third parties. The sharing of data with third parties is only done when strictly necessary. In all cases, Online Casino of the Year will comply with the AVG legislation, specifically article 28 et seq. AVG, as data controller.

We take appropriate and organizational measures (procedures, IT security, etc.) to ensure the confidentiality and integrity of your personal data and of the way it is processed.
Personal data can be accessed only by those authorized to do so. This personal data is password protected. The devices on which your data is stored are locked with a password and/or fingerprint scan and/or facial recognition. This obviously involves the necessary devices, such as computers, laptops and cell phones.
For the website or digital transmitted data, Online Casino of the Year uses firewalls, virus scanners and a periodic backup. Of course, backup does not include data whose retention period has expired. Passwords for systems are changed periodically and emails are cleaned periodically.

If your personal data is processed, you have privacy rights. When you exercise your right, we can best serve you if you are as specific as possible in your request. If the data kept by Online Casino of the Year is found to be incorrect, you have the right to have this data rectified. Online Casino of the Year will then replace the current incorrect data with the correct data.
You have the right to have personal data transferred by Online Casino of the Year to a similar party. This means a party that offers and performs roughly the same services as Online Casino of the Year.

In the event that you believe that Online Casino of the Year is not handling your personal data in a proper manner, you always have the right to file a complaint with the Personal Data Authority. You can do this through this link. The Personal Data Authority will handle your complaint further.
You have the right to object to data processing at any time. Especially in the case of “direct marketing.
Furthermore, we remind you of the following rights:
Right of restriction of all or part of the processing: under certain conditions you have the right to obtain from Online Casino of the Year the restriction of the processing of your personal data. In brief, this means that Online Casino of the Year temporarily “freezes” the processing of the data. You may exercise this right in four situations: (1) pending the assessment of a correction request, (2) if data should actually be deleted but you do not wish their deletion, (3) if Online Casino of the Year no longer needs the data while it is still necessary for (the preparation of) legal proceedings and (4) pending the assessment of an objection.
Withdrawal of consent: you have this right insofar as we process of your data on the basis of your consent. You have the right to withdraw a consent once given at any time. This has no consequences for the past, but does mean that we may then no longer process that data. Online Casino of the Year may no longer be able to provide you with certain services as a result.

For example, by asking you to provide us with a copy of your proof of identity. This is always done in the manner prescribed by the Central Government. In most cases, a less intrusive method of establishing identity will suffice. Use of the aforementioned rights is free of charge; barring misuse.
Please be advised that the rights described above are not absolute rights. There may be circumstances that prevent Online Casino of the Year from fulfilling a particular request. We will always evaluate each request on its own merits. Should we be unable to comply with a particular request, we will inform you of our reasons.
The data we collect from you is the minimum personal data necessary to provide our services, such as being able to vote for a nominee. If you do not provide this data, Online Casino of the Year cannot provide the services (properly).
If it is necessary to share your data with parties other than those listed in Article 6, your consent will first be sought. It may happen that our service changes or that a party receives data from us. We will announce changes through the Online Casino of the Year website.
Online Casino of the Year reserves the right to disclose data when required to do so by law, or when Online Casino of the Year deems it justified to comply with a legal request or process. We also reserve this right when ownership or protection of Online Casino of the Year is at stake. In doing so, we try to respect your right to privacy as much as possible.
